LANDOWNER LIABILITY

HB 1190 by Rep Guillen & Senator Zaffirini (Passed)

Allows landowners whose property is damaged as a result of a pursuit involving a federal law enforcement agency to be compensated from public funds acquired by the auction of abandoned vehicles.

SB 610 by Senator Perry & Rep Murr (Passed)

Provides liability protection for landowners and members of the agricultural community who provide agri-tourism-related services and activities on their property.

In 2011 STPRA was instrumental in passing S.B. 1160 which protects property owners from liability for the actions and omissions of peace officers, border patrol and firefighters on their properties and for injuries and deaths of trespassers who enter their properties. At the request of STPRA, State Representative Ryan Guillen sent a letter to the Attorney General last month asking for his opinion on whether S.B. 1160, along with the current agriculture statues, protects the landowner to the fullest degree possible.

S.B. 1160, STPRA was highly successful in passing legislation that protects property owners from liability for the actions and omissions of peace officers and firefighters on their properties and for injuries and deaths of trespassers who enter their properties. Our legislation, S.B. 1417 and H.B. 2950, became part of another bill, S.B. 1160, which prevents courts from limiting liability protection beyond that which has already been established in case law.

Governor Perry signed the bill into law May 20, 2011, and it became effective immediately. STPRA is delighted that we were so successful with the passage of this legislation and declares a huge victory for landowners!
